DMRC Staff say their demand for Salary Restructuring not yet been met

New Delhi: The Delhi Metro Rail Corporation has hit rough waters with its employees resorting to protests once again. The protesting non-executive employees of the corporation have now begun a hunger strike as they claim their demands for salary restructuring are going unheard by the administration.

As many as 3,600 employees, mainly technicians, are taking turns to protest at Jantar Mantar and at the seven metro depots. They are not ruling out train services being affected as 32 of those on hunger strike have already been hospitalized. Members of the staff council are likely to meet the administration on Monday to reach a common consensus.

They demand that the salaries of technicians be revised from Rs 8,000 – 14,140 to Rs 10,170 – 18,500. For senior technicians, they have demanded a hike in pay-scale from Rs 10,170 – 18,500 to Rs 14,000 – 26,950 and for head technicians from Rs 14,000 – 26,950 to Rs 16,000 – 30,770.

According to General Secretary, DMRC Employees Union, Kuldeep Maan, the employees fear that once the Seventh Pay Commission is implemented, their problems with the corporation would be quashed. “We have been victims of DMRC’s exploitation since 2007. Our protest has been on for long now but nothing has happened. On November 3, we decided to extend the protest to Jantar Mantar and November 5 onwards employees began their hunger strike,” he said.

To register his protest for the cause Kishan went a step ahead and resigned from his membership of the employees’ council. “So far, 32 of the many employees on hunger strike have been hospitalised. If the administration does now blink an eye many more will be taken ill and then we won’t be responsible if metro operations are hit,” said another protesting member. The administration had called for a meeting once, but it bore no fruitful conclusions, he added.

Responding to the report, the DMRC said, “It is an internal matter of the organization and the Human Resource department has taken up the issues of these employees.”

G.S.R – In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Lal Bahadur Shastri National Academy of Administration (Establishment Group ‘C’ and ‘D’ Posts) Recruitment Rules, 2000, in so far as they relate to the posts of Physical Training Instructor, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Physical Training Instructor, namely:-
1. Short title and commencement.- (1) These rules may be called the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, Lal Bahadur Shastri National Academy of Administration, Mussoorie (Physical Training Instructor) Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade payor pay scale.- The number of the post, their classification and the pay band and grade payor pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

3. Method of recruitment, age-limit, qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualifications.- No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, for reasons to be recorded in writing, in consultation with Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Class, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

DoPT issued an office memorandum regarding the functioning of Departmental Councils and it mentioned that the meetings of Departmental Council are essential as they help in resolving differences between Government and the Staff Side.

The undersigned is directed to refer to this Departments D.O. letter of even number dated 23.07.2012 (copy enclosed) regarding holding of meetings of Departmental Councils regularly with a view to make effective use of Joint Consultative Machinery (JCM) Scheme. Secretary, DoPT, had also vide his DO letters of even number dated 03.12.2012, 26.07.2013 and 17.02.2015 requested to promote this interaction more proactively through regular meetings of Departmental/Office Councils under the Ministry/Department.
The JCM Scheme provides for Departmental Councils at the level of individual Ministries/ Departments, including their attached and subordinate offices. The Staff Side of JCM, however, has been remonstrating that regular dialogue with the Staff Side through the mechanism of Departmental Councils at Ministry/Department level is not happening. Meetings of Departmental Council are essential as they help in resolving differences between Government and the Staff Side.

It is requested that suitable instructions may please be issued to hold meetings of Departmental Councils on regular basis.

Dear Sir,

Sub: Payment of Risk Allowance to the staff in the TRD Wing of Electrical Department on Indian Railways-Reg.
Ref: Railway Board’s letter No. E(P&A) I-2008 SP-I/AD-3 dated 02/05/2013.

The NFIR desires to bring to the notice of Railway Board that the staff working in TRD wing of Electrical Department are denied Risk Allowance even though these staff face continuous risk while perfoniing duties.
The TRD staff are engaged in the jobs listed vide annexure to Railway Board’s letter No. E(P&A)I-2008/SP-I/AD dated 02/05 /2013.

2. ln this connection, Federation desires to bring to the notice of the Railway Board following facts for appreciation of NFIR’s point of view:-
  • Though the TRD staff while working on the OHE, obtain Block and shut down the power carrying 2500 volt current duly earthing on both ends, but the power of same magnitude and intensity is available in the adjacent up/down line for the purpose of regular flow of rail traffic.
  • The high intensity current on the adjacent line causes severe adverse impact on the health of TRD staff due to inherent infection. This gives rise to various diseases as infection is being caused in the human body.
The seriousness can be assumed from the fact that if the amount of current in the human body crosses 40 mili-ampere, it can cause even deaths.

3. The NFIR therefore contends that the health hazards faced by the TRD Staff of Electrical Department in their day-to-day working are continuous and they are required to be paid Risk Allowance.

NFIR, therefore, requests the Railway Board to consider the case of TRD staff in all grades and accord approval for payment of Risk Allowance.

Federation may be kept advised of the action taken in the matter.

Subject: – Counting of past service fix admissibility in old pension scheme, new pension scheme, pay protection and leave accumulation to All India Services officers: clarification regarding.

I am directed to say that while introducing the New Pension Scheme from 01/01/2004, amendments to various existing rules including second proviso to Rule l of the All India Services (Death Cum Retirement Benefits) Rules, 1958 were made whereby these rules became inapplicable to those appointed to All India Service and posts from 01/01/2004. The pension of the member of All India Services appointed on or after 01/01/2004 is regulated by the New Defined Contribution Pension Scheme (known as the New Pension Scheme), notified by the Ministry of Finance (Department of Economic Affairs) vide their Notification No.5/7/2003-ECB2 PR dated 22/12/2003 now rechristened as National Pension System as per Section 8 of Pension Fund Regulatory Development Authority Act, 2013. The guidelines for New Pension Scheme in respect of All India Services was issued by this Department vide letter No.25014/14/2001-AIS(II) dated 08/09/2009 in terms of the instruction/guidelines notified by the Ministry of Finance.

2. Therefore, in view of the above new and changed position, this Department has received references from the State Governments and member of services for Clarification in regard to counting of past services for the purpose of pensionary benefits, pay protection and leave accumulation. The matter has been examined by this Department in consultation with the Ministry of Finance (Department of Expenditure) and Department of Pension and Pensioners’ Welfare and has decided as under: –
(i) The member of All India Services who had been an employee in pensionable establishment viz. Central/State Governments or autonomous bodies as on 31/12/2003 and appointed to All India Services on or after 01/01/2004 with proper permission shall be covered under the old non-contribution pension scheme in terms of Office Memorandum No. 28/30/2004-P&PW(B) dated 28/10/2009,which has been made applicable Mutatis-Mutandis to members of All India Services by this Department vide letter No. 25014/1/2013-AIS(II) dated 18/3/2013. The pay protection and leave accumulation arising out of previous service would be admissible as per relevant rules of respective All India Services (Pay) Rules and All India Services (Leave) Rules 1955.
(ii) Those under CPF etc will not be allowed entry into the old pension scheme on appointments from 01/01/2004
(iii) The member of All India Services who were appointed to government service in the central/state governments or autonomous bodies, whether in a pensionable or non-pensionable establishment, on or after 01/01/2004 before being appointed to All India Services shall be governed by the New Pension Scheme. The pay protection and leave accumulation arising out of their previous service would be admissible as per the relevant rules of the respective All India Services (Pay) Rules and All India Services (Leave) Rules, 1955.
(iv) The admissibility of counting of past services for the purpose of benefits as mentioned at point (i) and (iii) above shall be subject to continuous service and technical resignation.
3. The State Governments are competent to determine the past service rendered by the member of service for such benefits as mentioned above. The service rendered by a member of All India Services before his appointment to the service under the Central Government or a State Government will count as continuous service for the said benefits subject to the fulfilment of the specific conditions provided in the All India Services (Leave) Rules, 1955 and the respective All India Services (Pay) Rules. Approval of the Central Government is not necessary for counting the previous service for such benefits. In such cases the Government of the State on whose cadre the member of service is borne/the Accountant General concerned, will have to take necessary action in consultation with the Central Department or the State Government, if the officer had worked under the Central Government or another State Government, as the case may before joining the All India Services, to count such service as qualifying service for the aforesaid benefit. If any clarification is required or condonation of break in service is involved, a reference may be set to the Department of Personnel and Training in the case of members of the Indian Administrative Services, the Police Division of the Ministry of Home Affairs in the case of Indian Police Service and the Ministry of Environment, Forest and Climate Change in the case of members of Indian Forest Service.

The issue of providing various facilities, including scribes to persons with disabilities, for writing answers, in departmental examination has been under consideration of the Board for quite some time.

2. Accordingly, it has been decided by the Board that Instructions contained in this Ministry’s letters No.E(NG)II/2006/RC-2/13 dated 17.09.2007, 18.02.2011, 27.04.2012, 25.09.2013 and 19.12.2013 may be made applicable in case of  departmental examination also, wherever circumstances so warrant.

Attention is invited to para 2 (ii)(b) of this Ministry’s letter of even number dated 17/09/2007 regarding guidelines for providing concessions/facilities including scribes to persons with disabilities (PWDs), white conducting examination for their recruitment from open market.

Pursuant to advice of the Court of Chief Commissioner for Persons with Disabilities, in Case No.389/1041/2013 dated 13/9/2013 that criteria like educational qualification, marks secured, age or other such restriction for the scribe should not be fixed and instead, the invigilation system should be strengthened so that the candidates using scribe do not indulge in malpractices like copying and cheating during the examination, it has been decided by the Board to delete para 2 (ii)(b) of this Ministry’s fetter of even number dated 17/09/2007.

Further, where recruitment notices have already been published, the recruiting agency may also issue corrigendum, bringing this fact to the notice of all concerned.

Sub: Vacancies in Clerical Cadre – Direct Recruitment quota.

Attention is invited to Board’s letter of even number dated 15.6.2010 (RBE No.88/2010) on the above subject, wherein instructions had been issued for extending the currency of instructions contained in RBE No.210/1991 pertaining to freezing of 25% of the vacancies falling within the direct recruitment quota in the category of Clerks in Pay Band-I of Rs.5200-20200 (Grade Pay: Rs.1900) and in Senior Clerks in Pay Band-I of Rs.5200-20200 (Grade Pay: Rs.2800) and 20% in the category of Junior Accounts Assistant in Pay Band-I of Rs.5200-20200 (Grade pay: Rs.2800) and Accounts Clerk in Pay Band-I of Rs.5200-20200 (Grade Pay: Rs.1900). The question of continuance of the above freeze orders has been considered by the Board and it has been decided to extend the currency of the instructions mentioned for a further period up to 31.12.2013. Rest of the vacancies may be filled up after reviewing the requirement of clerical staff.

2. In this regard, Board also desire that the Railways and Production Units should furnish information regarding the sanctioned strength of Junior Clerk, Senior Clerk, Junior Accounts Assistant and Accounts Clerk as on 1.4.92 and as on 1.1.2013 as well as their views with respect to continuance or otherwise of such a freeze order for future in the said categories of staff.

3. The instructions will be effective from the date of expiry of earlier freeze order i.e. 0l.0l.2013.

4. It has also come to the notice of this Ministry that the instructions on this freeze order is being interpreted by certain railway establishments in the manner as if there is total ban to fill up the posts in question. It is clarified that these instructions only limit percentage of recruitment and should not be construed as complete ban. Remaining posts may, therefore, be filled up by the Railways in terms of instructions on the subject.

Meanwhile, we have also made a comparison of 7th Pay Commission Pay estimated by GConnect by adopting 6th CPC methods and 7CPC Pay proposed by National Council, Staff Side JCM and Confederation of Central Government Employees and Workers.
In this comparison, we have arrived at the Net increase in pay out of 7CPC Pay for employees in each grade pay which is calculated on the basis of present 6CPC pay along with DA as on January 2016 (125%).
This increase in Percentage has been calculated for 7th Pay Commission Pay estimated by GConnect and also for 7th CPC Pay proposed by JCM Seperately.
