Sir,

You are aware that payment of Bonus/Ex-gratia/recoverable festival advance is made every year to the employees of different Public Undertakings and that such payment are generally made before the autumnal festivals.

2. I am directed by the order of the Governor to say that the Governor has been pleased to take the following decisions:-

(a) Where the payment of Bonus Act 1965 as amended upto date is applicable, bonus for the year 2012-2013 will be payable according to the statutory provisions of the said Act as amended upto date. The employees who drew salary or wages upto Rs.10,000/- per month will be entitled to the bonus in the current year, subject to the condition that the maximum amount payable to an employee in such case will be restricted to the amount admissible to those drawing emoluments upto Rs.3,500/- per month. Similarly, where ex-gratia is paid in lieu of bonus under the payment of Bonus Act, 1965 the same provisions will have to be followed for the purpose of payment of ex-gratia.

    (b) (i) The employees of the Public Undertakings who are guided by the Payment of Bonus Act, 1965, as amended upto-date, but are not eligible to get Bonus/ex-gratia in lieu of bonus under the said Act on account of their revised emoluments having been exceeded Rs.10,000/- per month as on 31st March, 2013 may be allowed to draw an ex-gratia grant of Rs.2600/- per head provided their revised emoluments as on 31st March, 2013 did not exceed Rs.22,000/- per month.

    (ii) In the Public Undertaking/Statutory Bodies where the payment of Bonus Act, 1965, as amended upto-date is not applicable, but ex-gratia in lieu of bonus is sanctioned to the employees strictly following the provisions of the payment of Bonus Act, 1965, the employees of the said Undertakings/Statutory Bodies may also be granted an ex-gratia grant of Rs.2600/- per head provided dtheir revised emoluments as on 31st March, 2013 exceeded Rs.10,000/- per month but did not exceed revised emoluments of Rs.22,000/- per month.

Recoverable advance of maximum limit of Rs.2500/- may be sanctioned to the employees of Public Undertakings/Statutory Bodies not coming under the purview of Bonus/Ex-gratia provided their revised emoluments exceeded Rs.22,000/- per month but did not exceed Rs.30,000/- per month as on 31.3.2013 and also provided that the advance paid last year has been recovered in full.

3. While sanctioning Bonus/Ex-gratia in lieu of Bonus, the following principles shall be observed:-

    (i) Bonus at the statutory minimum rate will be paid to the employees of Public Undertakings/Statutory Bodies, who come under the purview of the payment of Bonus Act, 1965 as amended upto-date.

    (ii) No excess Bonus i.e. over and above the statutory minimum will be paid to the employees of Public Undertakings/Statutory Bodies under any circumstances, if the said Public Undertakings/Statutory Bodies are running under loss.

    (iii) For payment of statutory Bonus under the payment of Bonus Act, 1965, as amended upto-date and also for payment of ex-gratia payment in lieu of Bonus, final report of accounts of the previous year in respect of the concerned organization will have to be furnished to the Government.

    (iv) For justification of the additional rate of Bonus the previous year’s audited accounts should be furnished and quantum of Bonus should be computed according to the provision of the payment of Bonus Act.

    (v) The rate of ex-gratia payment in lieu of Bonus shall be 8.33 per cent of the emoluments earned by the employees during the accounting year in question irrespective of allocable surplus (as defined in the payment of Bonus Act, 1965, as amended upto-date). If the proposal in any rate about the aforesaid limit, the proposal should be justified on the basis of “Allocable Surplus” (as defined in the Payment of Bonus Act, 1965 as amended upto-date) during the account year in question. Here also the calculation will have to be made according to the principles for calculation of Bonus as laid down in the Payment of Bonus Act.

    (vi) For conversation of ex-gratia payment in lieu of Bonus so long paid into bonus under the payment of Bonus Act, specific views of the Labour Department nay be obtained. Labour Department is requested to clearly give their views in such cases in consultation with Ld. L.R. as to whether the concerned organization would come under the purview of the payment of Bonus Act (Under Section 31 of the Said Act).

4. I am, therefore, to request you kindly to take necessary action accordingly and issue orders in respect of the concerned organizations under your administrative control at an early date so that the payment of Bonus/ex-gratia to the eligible employees is completed by the 30th September, 2013.

5. For payment of Bonus/ex-gratia under this order and ex-gratia @ Rs.2600/- per head as per this order, no sanction of the Finance Department will be necessary, if there is no requirement of fund for release of the benefit.

OFFICE MEMORANDUM


Subject:    Period of retention of General Pool accommodation on retirement of allottees – Regarding

Consequent upon amendments in Supplementary Rules 317-B-11 and 317-B-22 of Allotment of Government Residences (General Pool in Delhi) Rules, 1963 vide Notification of even number dated 19.6.2013, the permissible period of retention of General Pool accommodation to the allottees who retire on or after 23.4.2013, is as under:-

    (a)    In cases of accommodation allotted prior to 01.07.2013: 2 months on normal licence fee, another 2 months on double of the normal licence fee, further 2 months on four times of the normal licence fee and subsequent 2 months on six times of the normal licence fee.

    (b)    In cases of accommodation allotted on or after 1.7.2013: 2 months on normal licence fee, another 2 months on double of the normal licence fee and further 2 months on four times of the normal licence fee.

2.    It is clarified that the period of retention of 8/6 months, as the case may be, shall be admissible to the allottees, who retire on or after 23.4.2013, automatically at one go without any request or production of certificate by the allottees. The allotment of the General Pool accommodation occupied by the retiring allottees shall be cancelled by Directorate of Estates after allowing a retention of 8/6 months, as the case may be, simultaneously. The allottees, however, shall have an option to vacate the accommodation anytime during the retention period.

3.    The retiring allottees shall request their DDOs to deduct the licence fee in respect of the accommodation occupied by them for the period they want to retain the same from their last pay bill and to remit the same online to Directorate of Estates. In case it is not deducted by DDOs, the allottees shall deposit the licence fee in the Directorate of Estates within one month after their date of retirement.

Government are pleased to sanction increase in the rates of Dearness Allowance from the existing 72% to 80% of the basic pension/family pension with effect from 1st January 2013 to the Pensioners/Family Pensioners who were drawing pay in the 2006 NJPC scales of pay.

2.    The increase in Dearness Allowance admissible under this order is payable in cash until further orders.

3.    The payment on account of the increase in Dearness Allowance as per this order involving fractions of 50 paise and above shall be rounded off to the next rupee and fractions less than 50 paise shall be ignored.

Sub - Sanction of 8% dearness relief on the Pension of the Pensioners of the State of Madhya Pradesh.

The State Government had sanctioned 72% dearness relief w.e.f. 01-11-2012 on pension/family pension to their pensioners/family pensioners vide Finance Department Memo No. F 9-4/2012/Rule/IV dated 19 November, 2012. The State Government has now decided that the dearness relief admissible to pensioners should be sanctioned as given below. The additional pension payable to the pensioner’s aged 80 years or above shall also qualify for dearness relief.

2.    The above dearness relief shall be payable on the Superannuation, Retiring, Invalid and Compensation Pension. This dearness relief shall also be payable on the Compassionate Allowance sanctioned to the employees discharged or removed from service and the said dearness relief shall also be payable to persons receiving family pension and extra ordinary pension under the restrictions contained in the Finance Department’s Memo No.F.B.6/43/76/R¬II/IV dated 5.10.76 . The dearness relief on the pension /family pension shall not be payable in the cases where the pensioners/ family pensioners are appointed/re- appointed under the State Government or autonomous institutions. This relief on family pension shall be payable in cases where a person at the time of the death of the spouse was in service and was not appointed on compassionate grounds. This relief on family pension shall not be payable in cases where a person on account of the death of the spouse has been appointed on compassionate grounds. In this connection attention is invited to the provisions contained in Finance Department’s Memo No.F.B.6/10/76/R-II/IV, dated 27.7.76 read with Memo No. No.F.B.6/10/77/R-II/IV, dated 2.5.77 and Memo No. F-12-5/2007/Rule/IV dated 19.4.2007

3.    Pensioners, who have commuted a part of their pension, shall be paid the dearness relief on their original pension (pension before commutation).

4.    This order shall be applicable in respect of State Government employees who had drawn lump sum amount on absorption in PSU/Autonomous body/Board /Corporation etc and have become eligible to restoration of 1/3rd commuted portion of pension in terms of this Department’s memo No. F 9/9/2006/Rule/IV dated 5-1-2007.

5.    Fraction of rupee of the amount to be paid as dearness relief shall be rounded off to the next rupee.

6.    All Treasury Officers/Sub Treasury Officers/ Pension Disbursing Officers are directed to make payment of the above sanctioned dearness relief to State Government Pensioners early, keeping in view the amended provisions of S.R.347 of the M.P.T.C. Volume-1, issued vide Finance Department’s endorsement No.E.-4/1/83/R-V/IV, dated 29th January, 1983. After payment of dearness relief the same may be got checked from the usual payment authority received from the Accountant General, Madhya Pradesh. If some inaccuracy/discrepancy comes to the notice, the same may be adjusted in the payment on next month.

Subject: Empanelment of private hospitals (including dental clinics and eve centres) and diagnostic centres under CGHS DELHI & NCR

The undersigned is directed to invite reference to the empanelment of hospitals under CGHS vide Ministry of Health and Family Welfare's Office Memorandum No: S.11011/23/2009-CGHS D.II/Hospital Cell (Part IX) dated 14.02.2013, vide which 'Continuous Empanelment Scheme' for private hospitals (including dental clinics and eye centres), diagnostic laboratories and Imaging Centres under CGHS was revived with a view to empanel more health care institutions for CGHS beneficiaries. Accordingly, after following due process, a list of following hospitals (including dental clinics and eye centres), diagnostic centres and Imaging centres has been finalized as per terms and conditions laid down in the O.M. referred to above as well as signing of MOA and execution of performance Bank Guarantee by them signifying acceptance of terms and conditions of empanelment and rates notified by CGHS in 2010 & in OM No. Misc.1002/2006/CGHS(R&H)/ CGHS (P) dated 7/2/2013.

2. The hospitals (including dental clinics and eye centres), diagnostic laboratories and Imaging Centres, which find their names in the list of hospitals, diagnostic laboratories and Imaging Centres approved for empanelment under CGHS in Delhi & NCR are empanelled for a period of one year from the date of issue of this Office Memorandum or till next new empanelment, whichever is earlier.

3. This Office Memorandum and the rates applicable under CGHS for hospitals (including dental clinics and eye centre), diagnostic laboratories and Imaging Centres can be downloaded from the website of CGHS, http://msotransparent.nic.in/cghsnew/index.asp.
